These two concepts are related. DUI & DWI litigation is very complex, and the defence are often counter-intuitive. The legally correct term is "Impaired Driving." The term "DUI" or "DWI" is considered an "American" term by Canadian lawyers, and it is not often used in court. This site uses the term "DUI" because it is designed to be accessible to the general public. This means that the accused did not provide either a roadside sample or a breathalyzer sample.
Driving Over 08 Laws

If you are charged with an "over 08," you want to show that the certificate of analysis is inadmissible. Driving "over 08" is a criminal offence as per section 253(1)(b) of the criminal code. This is a separate offence from impaired driving. Essentially, the police must prove that the accused's blood alcohol level was over the legal limit.
